Popscene House, operated by Ecomcht LLC, respects the intellectual property rights of others and expects our customers and suppliers to do the same. All designs on popscenehouse.com (the “Site”) are intended to be original, and we do not sell products that use the names, logos, lyrics, or artwork of artists, bands, labels, venues, or events without permission.

If you believe that material on the Site infringes your copyright, we will respond under the Digital Millennium Copyright Act (17 U.S.C. § 512).

1. Reporting Copyright Infringement (DMCA Notice)

To report alleged infringement, send a written notice to our designated agent (see Section 5) that includes all of the following:

  1. Your signature, physical or electronic, as the copyright owner or a person authorized to act on the owner’s behalf.
  2. Identification of the copyrighted work you claim was infringed. If several works are covered, a representative list.
  3. Identification of the infringing material on the Site, with enough detail for us to find it (for example, the product URL and product name).
  4. Your contact information: name, mailing address, telephone number, and email address.
  5. A statement that you have a good-faith belief that the use of the material is not authorized by the copyright owner, its agent, or the law.
  6. A statement, under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorized to act on the owner’s behalf.

Incomplete notices may not be actionable. Please note that under 17 U.S.C. § 512(f), a person who knowingly misrepresents that material is infringing may be liable for damages, including costs and attorneys’ fees.

2. What We Do When We Receive a Valid Notice

  • We review the notice promptly.
  • If it is valid, we will remove or disable access to the material and stop selling the product.
  • We may notify the person who supplied the material and give them a copy of your notice, which includes your contact details.
  • We may also let our print and fulfillment partners know, so that production of the item stops.

3. Counter-Notification

If you believe material was removed by mistake or misidentification, you may send us a counter-notification that includes:

  1. Your signature, physical or electronic.
  2. Identification of the material that was removed and where it appeared before removal.
  3. A statement, under penalty of perjury, that you have a good-faith belief the material was removed because of a mistake or misidentification.
  4. Your name, address, and phone number, and a statement that you consent to the jurisdiction of the federal court for the district where you live (or, if outside the U.S., any judicial district in which Ecomcht LLC may be found), and that you will accept service of process from the person who filed the original notice.

If we receive a valid counter-notification, we will send a copy to the person who filed the original notice. Unless that person notifies us within 10 business days that they have filed a court action seeking to restrain the alleged infringement, we may restore the material within 10 to 14 business days after receiving the counter-notification.

4. Repeat Infringers

It is our policy to terminate, in appropriate circumstances, the accounts and access of users or suppliers who are repeat infringers of copyright.

6. Trademark and Other Intellectual Property Claims

This policy covers copyright claims. If you believe a product on the Site infringes your trademark or other intellectual property rights, email us at [email protected] with: your contact details; the registration number or details of your right; the URL of the product; and a short explanation of the problem. We will review the claim and take appropriate action.

7. Changes to This Policy

We may update this policy from time to time. The updated version will be posted here with a new “Last updated” date.
